1. Agreement to Terms

AffRev ("the Service") is owned and operated by KYROS SOFTWARE LTD ("we", "us", or "our"), a company registered in England and Wales under company number 16915277, with its registered office at 82a James Carter Road, Mildenhall, Bury St. Edmunds, Suffolk, United Kingdom, IP28 7DE.

By accessing or using the Service, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. These terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

AffRev is an AI-powered funnel and offer page builder. The Service allows you to create, publish, and manage landing pages and sales funnels using artificial intelligence. We provide hosting, domain management tools, and related services as described on our website.

3. Accounts

To use certain features of the Service, you must register for an account. When you register, you agree to:

• —Maintain the security of your account credentials
• —Promptly update your account information if it changes
• —Accept responsibility for all activity that occurs under your account
• —Notify us immediately of any unauthorised use of your account

You may not use another person's account without permission. Accounts are for individual use unless you are on an Agency plan.

By creating an account — whether with Google or email OTP — you agree that we may add your email address to our mailing list (via Plunk) to send product updates, tips, and marketing related to AffRev. You can unsubscribe at any time using the link in those emails or by contacting us. This does not affect transactional emails required to operate your account (for example login codes).

4. Acceptable Use

You agree not to use the Service to:

• —Violate any applicable laws or regulations
• —Create or distribute spam, misleading content, or fraudulent offers
• —Infringe the intellectual property rights of others
• —Distribute malware, viruses, or other harmful code
• —Conduct phishing attacks or deceive end users
• —Create content that is defamatory, obscene, or harasses individuals
• —Promote illegal products or services
• —Violate the rights of any third party
• —Attempt to gain unauthorised access to our systems
• —Use the Service in any way that could disable, overburden, or impair it

We reserve the right to suspend or terminate accounts that violate these terms without notice.

5. Content Ownership

You retain ownership of the content you create using the Service. By using AffRev, you grant us a limited, non-exclusive licence to host, store, and display your content solely for the purpose of providing the Service to you.

You are solely responsible for your content. You represent and warrant that you have all rights necessary to use and publish your content, and that your content does not violate any third-party rights.

6. AI-Generated Content

The Service uses artificial intelligence to generate content including landing pages, copy, and designs. You acknowledge that:

• —AI-generated content may not always be accurate, complete, or fit for purpose
• —You are responsible for reviewing and approving all content before publishing
• —AI-generated content may be similar to content created for other users
• —We do not guarantee the uniqueness or originality of AI-generated content
• —You bear sole responsibility for the claims made in your published funnels

7. Payments and Subscriptions

Paid plans are billed on a subscription basis. By subscribing to a paid plan, you agree to the following:

• —Subscription fees are charged in advance on a monthly or annual basis
• —Payments are processed securely through Stripe
• —Subscriptions automatically renew unless cancelled before the renewal date
• —Refunds follow our Refund Policy (7-day window on initial subscription; see /refund)
• —Prices may change with 30 days notice to active subscribers
• —Downgrading your plan may result in loss of access to certain features

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period.

8. Intellectual Property

The Service, the AffRev name and brand, and its original content (excluding user-generated content), features, and functionality are and will remain the exclusive property of KYROS SOFTWARE LTD and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your internal business purposes.

If you believe content on the Service infringes your copyright, contact us at [email protected] with enough detail for us to identify the material and respond. We may remove or disable access to content we reasonably believe infringes rights.

9. Third-Party Services

The Service integrates with third-party services including Google (authentication), Stripe (payments), Meta/Instagram, OpenRouter (AI), Plunk (email), Cloudflare (infrastructure), and PostHog (analytics). These services are governed by their own terms of service and privacy policies. We are not responsible for the practices of third-party services. See our Privacy Policy for the full processor list.

10. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

11. Limitation of Liability

To the fullest extent permitted by law, KYROS SOFTWARE LTD shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages. Our total liability to you shall not exceed the amount paid by you to us in the twelve months preceding the claim. Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under the laws of England and Wales.

12. Indemnification

You agree to defend, indemnify, and hold harmless KYROS SOFTWARE LTD and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in connection with your use of the Service, your content, or your violation of these terms.

13. Termination

We may terminate or suspend your account and access to the Service at any time, with or without cause and with or without notice, if we believe you have violated these terms. You may also terminate your account at any time by contacting us.

Upon termination, your right to use the Service will immediately cease. Published funnels will be taken offline within 30 days of account termination. We are not liable to you or any third party for termination of your account.

14. Changes to Terms

We reserve the right to modify these terms at any time. We will notify you of material changes by email or via a notice on the Service. Your continued use of the Service after any changes constitutes your acceptance of the new terms. If you do not agree to the updated terms, you must stop using the Service.

15. Governing Law

These terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where applicable consumer law entitles you to bring proceedings in your country of residence.
